Seoul, South Korea – The Seoul Central District Court has granted bail to former Defense Minister Kim Yong-hyun, who is implicated in an alleged insurrection plot. The court’s decision, announced on June 16th, comes amidst concerns about the length of the trial and the defendant’s right to a fair hearing.

The 25th Criminal Division of the Seoul Central District Court ruled to release Kim, who was previously arrested on charges of executing critical tasks related to insurrection and abusing his authority.

In its statement, the court cited the Criminal Procedure Act, which stipulates a maximum six-month detention period for defendants during the first instance trial. The court expressed concerns that the trial might exceed this timeframe. Therefore, in accordance with precedent, the court has decided to grant bail to the defendant to ensure his appearance in court and to prevent the destruction of evidence, the statement read.

As conditions for his release, Kim Yong-hyun is required to post bail of 100 million Korean won (approximately $76,000 USD). He is also prohibited from leaving his residence and from contacting any suspects, defendants, individuals involved in the case, witnesses, or their representatives and relatives through any means, including meetings, phone calls, letters, faxes, emails, or text messages.

The case has drawn significant attention in South Korea, raising questions about the extent of the alleged insurrection plot and the involvement of high-ranking officials. The decision to grant bail reflects the court’s commitment to balancing the need for a thorough investigation with the defendant’s rights under the law. The trial is expected to continue in the coming months.
