Seoul, April 29 (Yonhap) – Amidst reports and subsequent confirmation from North Korea regarding its deployment of troops to support Russia in the ongoing conflict in Ukraine, the South Korean government has reaffirmed its unwavering stance on accepting North Korean soldiers who wish to defect.

Our position remains firm: should any North Korean soldier captured by Ukrainian forces express a desire to defect to South Korea, the government will exert diplomatic efforts to facilitate their transfer, a South Korean Foreign Ministry official stated on Monday.

The statement comes as concerns rise over the potential fate of North Korean soldiers fighting in Ukraine, particularly regarding their treatment as prisoners of war (POWs) and the possibility of forced repatriation.

Regardless of whether North Korea acknowledges its military involvement in Ukraine, captured North Korean soldiers are considered POWs and are entitled to protection under international law, the official emphasized. They should not be sent to places against their will where they could face persecution. This aligns with international law and established practices.

This declaration directly addresses the potential for North Korean POWs to be forcibly returned to North Korea, a scenario that Seoul views as a violation of international legal principles. The Geneva Convention Relative to the Treatment of Prisoners of War stipulates that POWs should be released and repatriated without delay after the cessation of hostilities. However, the South Korean government argues that forcibly returning North Korean POWs against their will would contravene international legal norms, particularly the principle of non-refoulement, which prohibits returning individuals to a country where they face persecution.

The North Korean confirmation of troop deployment, disseminated through state media outlets like the Rodong Sinmun, has fueled speculation that Pyongyang may seek to actively participate in negotiations concerning the repatriation of POWs. This raises concerns about the potential for North Korea to pressure for the return of its soldiers, regardless of their individual wishes.

The South Korean government’s renewed commitment to accepting defecting North Korean soldiers underscores its long-standing policy of providing refuge to those fleeing the oppressive regime in Pyongyang. It also highlights Seoul’s commitment to upholding international law and humanitarian principles in the context of the ongoing conflict in Ukraine.

The situation remains complex, with the potential for diplomatic tensions between South Korea, North Korea, Russia, and Ukraine. The future treatment of North Korean soldiers captured in Ukraine will likely be a significant point of contention in any future negotiations related to the conflict.
